Legacy Installs – Terms & Conditions

1. Introduction & Agreement

Legacy Installs Ltd (“Legacy”, “we”, “us”, or “our”) is a limited company providing services related to the planning, design, supply, and installation of home gym spaces. Legacy also offers coaching and training-related services to support installed spaces and to individuals seeking coaching independently of any installation service.

 

These Terms and Conditions apply to all individuals or entities (“the Client”, “you”, or “your”) who enquire about, purchase, or otherwise use any services provided by Legacy.

By accessing or using the Legacy website, submitting an enquiry, or purchasing any service (including but not limited to installations, equipment supply, or coaching services), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

 

Legacy reserves the right to amend or update these Terms and Conditions at any time. Any changes will take effect immediately upon being published on the Legacy website. It is the Client’s responsibility to review the Terms and Conditions periodically to remain informed of any updates.

 

2. Definitions & Interpretation

In these Terms and Conditions, the following definitions apply:

 

“Legacy”, “We”, “Us”, or “Our” refers to Legacy Installs Ltd.

 

“Client”, “You”, or “Your” means any individual or entity who enquires about, purchases, or uses the Services.

 

“Services” means any service provided by Legacy, including but not limited to home gym installations, equipment supply, and coaching services.

 

“Home Install” means the planning, design, delivery, and installation of gym equipment within a residential property.

 

“Coaching Services” means training plans, guidance, advice, or educational fitness content provided by Legacy, whether delivered in person or remotely.

 

“Equipment” means any fitness or gym equipment supplied, installed, or recommended by Legacy.

 

“Site” means the property or location at which a Home Install is carried out.

 

“Third-Party Contractor” means any external individual or entity engaged by Legacy to assist with aspects of the Services.

 

“Completion” means the point at which the agreed Services have been delivered and/or installed in accordance with the agreed specification.

 

“Quote” means a written estimate provided by Legacy outlining the scope and cost of the Services.

 

“Deposit” means any upfront payment required prior to commencement of the Services.

 

“Fees” means all charges payable by the Client for the Services.

 

“Agreement” means the binding contract formed between Legacy and the Client, 

incorporating these Terms and Conditions and any applicable written quotation or proposal.

 

“Liability” means responsibility for loss, damage, injury, or claim arising in connection with the Services.

 

“Website” means the official Legacy website used for information, enquiries, and service promotion.

 

“Force Majeure” means any event beyond the reasonable control of Legacy, including but not limited to adverse weather conditions, illness, supply chain delays, or acts of God.


Headings are for convenience only and do not affect the interpretation of these Terms and Conditions.

 

3. Scope of Services (General)

Legacy provides Home Install Services and Coaching Services, as described below. The exact scope of Services provided will depend on the package selected and any written agreement between Legacy and the Client.

 

3.1 Home Install Services

Home Install Services include the design, planning, delivery, installation, and set-up of the agreed home gym installation, as outlined in the Client’s accepted Quote.

 

Home Install Services commence following an enquiry submitted through the Legacy Website or via another official communication channel, including email or telephone, and once a Quote has been accepted by the Client.

3.2 Coaching Services

Coaching Services are provided as a subscription-based service and consist of non-medical training plans, guidance, advice, and/or educational fitness content.

 

Coaching Services are not intended to provide medical, therapeutic, or rehabilitation advice. All training plans and guidance are undertaken by the Client at their own risk.

 

Legacy does not guarantee specific outcomes or results from Coaching Services, as results depend on individual effort, consistency, and external factors.

 

Coaching Services may be delivered remotely via digital platforms unless otherwise expressly agreed in writing.

3.3 Exclusions

Unless expressly agreed in writing, the following are excluded from the Services:

General:

  • Legacy does not guarantee specific outcomes or performance improvements.

  • Legacy is not responsible for issues arising from misuse of Equipment or failure to follow provided guidance.

  • Legacy is not responsible for delays caused by suppliers, manufacturers, or Third-Party Contractors.

  • Legacy is not responsible for additional costs arising from inaccurate or incomplete information provided by the Client.

  • Any services not expressly included within the agreed Quote or package are excluded from the Services.

Home Install Services:

  • Installation of pre-designed home gym layouts not created or approved by Legacy

  • Coaching Services, which are not included with Home Install Services unless expressly stated

  • Structural alterations, building works, or modifications to walls, floors, ceilings, or utilities

  • Any electrical, plumbing, or gas-related works unless expressly agreed in writing

  • Obtaining planning permission, building control approval, or landlord consent

  • Assessment of structural integrity or load-bearing capacity of floors, walls, or ceilings

  • Removal or disposal of existing furniture or equipment unless agreed in writing

Coaching Services:

  • In-person personal training or supervised exercise sessions

  • Medical advice, diagnosis, treatment, or rehabilitation services

  • Nutritional advice, meal planning, or dietary prescriptions unless expressly stated

  • Mental health, psychological, or counselling services

  • Injury rehabilitation, physiotherapy, or corrective exercise programmes

3.4 Service Variations

Packages offered by Legacy vary in content. The Services provided may differ depending on the package selected, and only those Services expressly included within the agreed package or Quote will be provided.

Legacy reserves the right to refuse or suspend Services where Site conditions, client conduct, or undisclosed information make it unsafe or unreasonable to proceed.

Any changes to the agreed Services, including upgrades or additions, must be agreed in writing and may be subject to additional Fees.

 

4. Home Gym Installations

4.1 Site Access & Preparation

The Client is responsible for ensuring that the Site is suitable, safe, and accessible for the provision of the Home Install Services.

Client Responsibilities include, but are not limited to:

  • Providing clear and safe access to the Site, including a clear route for Legacy personnel and any Third-Party Contractors, suitable access for the movement of Equipment into and out of the Site, and adequate areas for loading and unloading.
     

  • Providing suitable parking arrangements for Legacy personnel and any Third-Party Contractors where reasonably required.
     

  • Ensuring that the working area is clear, unobstructed, and ready for the Home Install Services to be carried out, including the removal of any existing furniture, equipment, or other obstructions unless otherwise agreed in writing.
     

  • Ensuring the structural suitability of the Home Install area, including but not limited to the load-bearing capacity of floors, walls, and ceilings, and the presence or location of any live services that may interfere with the installation.
     

  • Ensuring that the Site has adequate power supply, lighting, ventilation, and space for the Home Install Services to be commenced and completed, unless otherwise expressly agreed in writing.
     

  • Legacy shall not be responsible for any hidden defects, latent conditions, or pre-existing issues at the Site that are not reasonably apparent prior to or during the installation process.

 

Legacy reserves the right to delay, suspend, or refuse installation where Site conditions are unsafe or unsuitable, without liability for resulting delays and/or costs.

4.2 Installation Limitations

Unless expressly stated otherwise in writing, all Home Install Services are non-structural in nature. Any structural alterations or building works must be separately agreed in writing and may be subject to additional contracts, permissions, and Fees.

 

Legacy accepts no responsibility for building modifications, structural works, or alterations unless expressly agreed in writing.

 

All existing structures at the Site, including but not limited to walls, floors, ceilings, and fixings, must be suitable for the installation of the Equipment. Legacy does not provide structural assessments or guarantees regarding the suitability of existing structures.

 

Legacy shall not be responsible for cosmetic damage, surface marks, or minor wear resulting from reasonable installation activities.

 

Legacy is not responsible for damage arising from hidden services, latent defects, or pre-existing conditions within the Site that were not reasonably apparent prior to installation.

 

Legacy reserves the right to modify or decline installation methods where existing structures are deemed unsuitable or unsafe.

4.3 Safety & Use

All Equipment must be used strictly in accordance with the safety briefing provided by Legacy following installation and in accordance with the manufacturer’s instructions and guidelines. The Client is responsible for reading, understanding, and complying with all such instructions prior to use.

 

Following Completion of the Home Install Services, all responsibility for the safe use, operation, supervision, and maintenance of the Equipment rests solely with the Client.

 

Legacy accepts no responsibility for how the Equipment is used after Completion and shall not be liable for any injury, loss, or damage arising from misuse, failure to follow instructions, or use of the Equipment contrary to guidance provided.

 

Legacy does not provide ongoing supervision, monitoring, or instruction for the use of Equipment following installation unless expressly agreed in writing.

 

The Client is responsible for ensuring that all users of the Equipment are suitably informed, supervised, and capable of using the Equipment safely.

4.4 Third-Party Contractors & Subcontracting

Legacy may engage Third-Party Contractors to assist with the provision of Home Install Services. Such Third-Party Contractors may carry out specific elements of the Services on behalf of Legacy.

 

Legacy shall not be liable for delays caused by Third-Party Contractors where such delays are outside Legacy’s reasonable control.

 

Where Third-Party Contractors are engaged, Legacy’s role is limited to coordination and project management of the relevant Services, unless otherwise expressly agreed in writing.
 

Third-Party Contractors remain responsible for their own acts, omissions, and compliance with applicable laws and regulations.

4.5 Completion, Handover & Defects Reporting

Home Install Services shall be deemed complete upon completion of the agreed works in accordance with the accepted Quote and confirmation of handover to the Client (“Completion”).

 

The Client must inspect the Home Install Services upon Completion and report any defects or issues in writing to Legacy within 72 hours of Completion.

 

Any defects or issues not reported within this timeframe shall be deemed accepted, except where such defects could not reasonably have been identified at the time of Completion.

 

Where valid defects are reported within the specified timeframe, Legacy will arrange for personnel or a Third-Party Contractor to attend the Site within a reasonable period, typically within 14 days where reasonably practicable, to assess and rectify the reported defect where appropriate.

 

Legacy reserves the right to determine the appropriate method of rectification.

4.6 Delays, Access Issues & Client-Caused Interruptions

Legacy shall not be responsible for delays to the Home Install Services where such delays arise from circumstances outside Legacy’s reasonable control.

 

The Client is responsible for ensuring timely access to the Site at the agreed dates and times. Where access to the Site is not available, restricted, or delayed due to the actions or omissions of the Client, Legacy reserves the right to delay or reschedule the Home Install Services.

 

Where delays or interruptions are caused by the Client, including but not limited to failure to provide access, unsuitable Site conditions, incomplete preparation, or undisclosed information, Legacy may charge additional Fees to cover additional time, labour, storage, or reattendance costs.

 

Legacy shall not be liable for delays or additional costs resulting from inaccurate, incomplete, or late information provided by the Client.

 

Where a Home Install is delayed or interrupted due to Client-caused circumstances, Legacy reserves the right to suspend the Services until such issues are resolved.

 

Any revised installation dates will be subject to availability.

 

5. Equipment Supply

All Equipment supplied by Legacy shall remain the property of Legacy until Completion of the Home Install Services and receipt of full payment of all applicable Fees.

 

Risk in the Equipment shall pass to the Client upon Completion. From that point, the Client is responsible for the care, use, and storage of the Equipment.

 

Where applicable, manufacturer warranties apply to the Equipment and will be transferred or provided to the Client upon Completion. Any misuse of the Equipment, failure to follow manufacturer instructions, or use contrary to guidance provided by Legacy may result in the voiding of such warranties.

 

Legacy shall not be responsible for cosmetic damage, surface marks, or minor wear resulting from reasonable installation activities.

 

The Client is responsible for ensuring that the Equipment is stored and used in a suitable environment, including appropriate temperature, humidity, ventilation, and protection from moisture, both during the installation process and following Completion.

 

 

6. Coaching Services
6.1 General Nature of Coaching

Coaching Services are provided as a subscription-based service and consist of non-medical training plans, guidance, advice, and/or educational fitness content.

 

Coaching Services are not intended to provide medical, therapeutic, rehabilitative, or diagnostic advice. All training plans, guidance, and recommendations are undertaken by the Client at their own risk.

 

Legacy does not guarantee any specific outcomes or results from Coaching Services, as results depend on individual effort, consistency, adherence, and external factors beyond Legacy’s control.

 

Coaching Services may be delivered remotely via digital platforms unless otherwise expressly agreed in writing.

6.2 Client Responsibility

The Client confirms that they are physically fit to participate in training and exercise prior to commencing Coaching Services. Legacy may require confirmation of fitness to train before providing Coaching Services, and failure to provide such confirmation may result in the Services being suspended or not provided.

 

The Client is responsible for disclosing fully and accurately any injuries, medical conditions, illnesses, or physical limitations that may affect their ability to participate in Coaching Services or safely follow the training guidance provided.

 

The Client is responsible for obtaining medical clearance prior to commencing Coaching Services where advised to do so by a medical professional or where they have any pre-existing health concerns.

 

The Client must promptly inform Legacy of any changes to their health or physical condition that may affect their ability to safely participate in Coaching Services.

 

At any point during participation in Coaching Services, if the Client experiences pain, discomfort, dizziness, or any adverse symptoms, the Client must immediately cease training and seek appropriate medical advice before continuing.

 

Legacy is not responsible for any injury, loss, or damage arising from the Client’s failure to disclose relevant information or failure to follow the guidance provided.

6.3 Results Disclaimer

Legacy does not guarantee any specific outcomes or results from Coaching Services, as results depend on individual effort, consistency, adherence to guidance, and external factors beyond Legacy’s control.

 

Factors affecting results may include, but are not limited to, the Client’s training frequency, intensity, recovery, nutrition, lifestyle, stress levels, sleep, prior training history, and compliance with the guidance provided.

 

The Client acknowledges that Coaching Services provide guidance and support only, and that progress and results ultimately depend on the Client’s actions and circumstances.

6.4 Remote Coaching Limitations

Legacy Coaching Services are provided without physical supervision. Where Coaching Services are delivered remotely, the Client undertakes all training activities independently and without real-time monitoring or oversight by Legacy.

 

The Client acknowledges and accepts that unsupervised exercise carries inherent risks and agrees that all such risks are assumed solely by the Client.

 

Legacy does not monitor exercise execution, environment, equipment setup, or training conditions during remote Coaching Services and accepts no responsibility for injury, loss, or damage arising from the Client’s participation in unsupervised training.

 

 

7. Health, Medical & Liability Disclaimer

The Client confirms that they are medically fit to participate in physical exercise and, where appropriate, have obtained medical clearance from a qualified healthcare professional prior to using any Services provided by Legacy.

 

The Client acknowledges that participation in physical exercise, training, and the use of fitness equipment carries inherent risks. All Services provided by Legacy are used at the Client’s own risk.

 

To the fullest extent permitted by law, Legacy shall not be responsible or liable for any injury, loss, damage, illness, or death arising from or in connection with the use of the Services, the use of Equipment, or participation in any training activities, except where such liability cannot be excluded by law.

 

Nothing in these Terms and Conditions shall exclude or limit Legacy’s liability for death or personal injury caused by negligence where such exclusion is not permitted under applicable law.

 

 

8. Payments, Pricing & Invoicing
8.1 General

All prices for Services are provided in writing by Legacy and are subject to acceptance by the Client. Prices may vary depending on the scope of Services selected, and any additional Services requested may be subject to additional Fees.

 

Legacy reserves the right to amend pricing for future Services at any time. Any changes to pricing will not affect Services already paid for or agreed in writing.

 

8.2 Coaching Services – Subscription Payments

Coaching Services are provided on a monthly subscription basis and are billed in advance.

 

By subscribing to Coaching Services, the Client agrees to pay the applicable monthly Fee in advance for each billing period. The subscription will continue on a rolling monthly basis until cancelled by the Client.

 

Cancellation of a Coaching Services subscription will prevent future billing but will not entitle the Client to any refund for the current or any previous billing period. No refunds are provided for partially used subscription periods.

 

Legacy reserves the right to suspend or terminate Coaching Services where payment is not received when due.

8.3 Home Install Services – Deposits & Final Payment

A deposit is required to secure a Home Install booking and confirm acceptance of the Client’s Quote.

 

The deposit becomes non-refundable once work has commenced, including but not limited to planning, design work, or the ordering of Equipment.

 

The remaining balance of Fees for Home Install Services shall be invoiced upon Completion and is payable immediately upon receipt of the invoice, unless otherwise expressly agreed in writing.

 

Legacy reserves the right to withhold handover, documentation, warranties, or completion confirmation until full payment has been received.

8.4 Late Payment

Where payment is not received by the due date, Legacy reserves the right to suspend Services until payment is made in full.

 

Legacy may charge reasonable administrative or recovery costs arising from late payment, where permitted by law.

8.5 Additional Costs & Variations

Any changes to the agreed Services, including variations, upgrades, or additions requested by the Client, must be agreed in writing and may result in additional Fees.

 

Legacy shall not be responsible for delays or additional costs arising from changes requested by the Client after Services have commenced.

 

9. Cancellations, Rescheduling & Refunds
9.1 Home Install Services – Cancellations

The Client may cancel Home Install Services prior to commencement of work.

 

For the purposes of these Terms and Conditions, commencement of work includes, but is not limited to, planning, design finalisation, scheduling, or the ordering of Equipment or materials.

 

Where cancellation occurs before work has commenced, any deposit paid may be refunded at Legacy’s discretion, less any reasonable costs already incurred.

 

Where cancellation occurs after work has commenced, the deposit shall be non-refundable. Legacy reserves the right to recover any additional costs incurred beyond the deposit where applicable.

9.2 Coaching Services – Cancellations

Coaching Services are provided on a rolling monthly subscription basis.

 

The Client may cancel their Coaching Services subscription at any time. Cancellation will prevent future billing but will not entitle the Client to a refund for the current or any previous billing period.

 

No refunds are provided for partially used subscription periods.

9.3 Refunds

Except where required by law, all payments made to Legacy are non-refundable.

 

Refunds are not provided for:

 

  • Completed Home Install Services
     

  • Deposits once work has commenced
     

  • Partially used Coaching Services subscription periods
     

Nothing in these Terms and Conditions affects the Client’s statutory rights.

9.4 Force Majeure

Legacy shall not be liable for any failure or delay in the performance of Services where such failure or delay arises from events beyond Legacy’s reasonable control.

 

Such events may include, but are not limited to, adverse weather conditions, illness or injury, supplier or manufacturer delays, transport disruption, acts of God, government restrictions, or other circumstances outside Legacy’s reasonable control.

 

Where a Force Majeure event occurs, Legacy will use reasonable efforts to resume Services as soon as practicable. Any affected installation dates may be rescheduled subject to availability.

 

10. Intellectual Property

All Coaching Services training plans, programmes, written materials, and related content provided by Legacy remain the intellectual property of Legacy at all times, regardless of whether such materials have been distributed to the Client as part of the Services.

 

The Client is granted a limited, non-transferable, non-exclusive licence to use Coaching Services materials for their personal use only. Such materials may not be copied, shared, reproduced, distributed, resold, or otherwise made available to any third party without the prior written consent of Legacy.

 

All content available on the Legacy Website, including but not limited to text, images, graphics, logos, training materials, and design elements, remains the intellectual property of Legacy and may not be used, reproduced, or distributed without prior written permission.

 

11. Limitation of Liability

To the fullest extent permitted by law, Legacy’s total liability to the Client arising out of or in connection with the Services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the total Fees paid by the Client for the specific Services giving rise to the claim.

 

Legacy shall not be liable for any indirect, incidental, consequential, or special loss or damage, including but not limited to loss of profit, loss of income, loss of business, loss of opportunity, or loss of data, arising out of or in connection with the Services.

 

Legacy shall not be liable for any loss, damage, injury, or claim arising from misuse of Equipment, failure to follow instructions or guidance provided, or use of the Services contrary to advice or recommendations given.

 

Nothing in these Terms and Conditions shall exclude or limit Legacy’s liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.

12. Insurance

Legacy maintains appropriate insurance coverage in accordance with applicable legal requirements for the Services provided.

 

Insurance coverage is held to support Legacy’s activities in connection with Home Install Services and Coaching Services, including public liability and, where applicable, professional liability.

 

Nothing in these Terms and Conditions shall be construed as creating any additional rights for the Client under Legacy’s insurance policies, nor as a guarantee that any particular claim will be covered by such insurance.

 

13. Privacy & Data Protection

Legacy is committed to protecting the privacy and personal data of its Clients and handling such data in accordance with applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

 

Personal data collected in connection with the Services will be used solely for the purposes of providing and administering the Services, communicating with the Client, processing payments, and complying with legal obligations.

 

Further details regarding how Legacy collects, uses, stores, and protects personal data, including information on Client rights, are set out in Legacy’s Privacy Policy, which forms part of these Terms and Conditions.

 

By using the Services, the Client acknowledges that they have read and understood the Privacy Policy.

 

14. Complaints & Dispute Resolution

If the Client has any concerns or complaints regarding the Services, they should raise them with Legacy as soon as reasonably practicable and in writing.

14.1 Home Install Services

In relation to Home Install Services, any defects, issues, or concerns must be reported in accordance with Section 4.5 of these Terms and Conditions. For clarity, defects must be reported in writing within 72 hours of Completion, except where such defects could not reasonably have been identified at the time of Completion.

 

Legacy will review any valid complaint or defect report and take reasonable steps to investigate and, where appropriate, resolve the issue within a reasonable timeframe.

14.2 Coaching Services

In relation to Coaching Services, any concerns or complaints should be raised in writing as soon as reasonably practicable. Legacy will use reasonable efforts to address and resolve such concerns promptly.

14.3 Dispute Resolution

Where a dispute arises in connection with the Services, the Client agrees to engage in good faith with Legacy to attempt to resolve the matter informally before pursuing formal legal action.

 

Nothing in this section shall prevent either party from seeking legal remedies where informal resolution is not possible or appropriate.

 

15. Governing Law & Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

 

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
